Will the Right to Disconnect legislation affect your ability to maintain relationships with clients who expect a quick response?

Real estate agents and property managers are often tied to their phones, but with the "Right to Disconnect" law that took effect on Monday, they now have the option to turn off all electronics at the end of the working day and refuse contact until the following morning.

The basics: what is the Right to Disconnect? 

The Right to Disconnect is a new workplace entitlement that allows most employees to refuse to answer emails, texts, or take calls from their bosses and clients outside of their working hours, unless it would be unreasonable.

It also ensures that employers cannot penalise workers for exercising their right to disconnect after hours.

While the new legislation gives employees the right to ignore their bosses and clients outside of working hours “unless it would be unreasonable to do so,” the challenge lies in the fact that there’s no clear definition of "unreasonable.”

Who does this relate to? 

Under the new legislation, companies with more than 15 employees are legally required to respect their employees' right to disconnect during non-working hours.

Smaller businesses are not immediately subject to this rule, but they will need to comply by 2025. This phased approach gives smaller businesses additional time to adjust to the new law.

Healthy work/life balance 

Despite juggling the demands of a successful business, Kelley Seaton, CEO and director of The Leasing Network, thinks the new law is a step in the right direction.

She said the “Right to Disconnect” is about managing boundaries, setting clear expectations, and ensuring both employers and clients adjust to this healthier balance between work and personal life. "We’ve got to set boundaries with our clients and ensure they know when we’re available. It’s all about establishing a clear cut-off between work and home."
